1st Circuit Reverses Appraisal Award Against Insurer In Flood Coverage Dispute

BOSTON - The First Circuit U.S. Court of Appeals on Sept. 20 ruled that a lower federal court erred in finding that an insured filed a proof of loss that complied with his Standard Flood Insurance Policy (SFIP) for additional payments for flood damage, reversing a $99,805.67 award against the insurer in a coverage dispute arising from torrential rains (Wayne DeCosta v. Allstate Insurance Co., No. 13-1176, 1st Cir.; 2013 U.S. App. LEXIS 19400).
