WORCESTER, Mass. - Defendants at a deposition in a previous action shared sufficiently similar motives to allow its use in a new action against two other defendants, a federal judge in Massachusetts held Sept. 24 in refusing to strike it and denying summary judgment (Nora M. Barraford, et al. v. T&N Limited, f/k/a T&N PLC, et al., Katherine Lydon, et al. v. T&N Limited, et al., Nos. 12-10013, 12-10014, D. Mass.; 2013 U.S. Dist. LEXIS 136457).
