Army Corps Of Engineers Properly Awarded Permit To Move Soil, Judge Rules

EAST ST. LOUIS, Ill. - The U.S. Army Corps of Engineers did not act arbitrarily and capriciously when providing an Illinois waste management company with a Clean Water Act Section 404 permit to move soil at its landfill, a federal judge in Illinois ruled Sept. 27, ruling that there is no causal relationship between the issuance of the permit and the company's plan to expand the landfill (American Bottom Conservancy v. U.S. Army Corps of Engineers, et al., No. 09-603-GPM, S.D. Ill.; 2013 U.S. Dist. LEXIS 138705).
