Missouri Federal Magistrate Tosses Federal Claim Over Unsolicited Fax

SPRINGFIELD, Mo. - A Missouri federal magistrate judge on Sept. 26 denied a Missouri company's motion for class certification of its Telephone Consumer Protection Act (TCPA) claim against another company accused of faxing an unsolicited advertisement and dismissed the TCPA claim, leaving the company to proceed with its remaining state conversion claim (Goans Acquisition, Inc. v. Merchant Solutions, LLC, et al., No. 12-539, W.D. Mo.; 2013 U.S. Dist. LEXIS 138228).
