Federal Judge: No Duty Of Care By Insurance Agent In Recommendation Of Coverage

LEXINGTON, Ky. - A jury could not conclude that there was an implied assumption of the duty of care by an insurance agent in the recommendation of pollution insurance coverage, a Kentucky federal judge ruled Oct. 8, dismissing a negligence claim (Hardy Oil Company Inc. v. Nationwide Agribusiness Insurance Co. and Wells Fargo Insurance-Indiana, No. 11-00075, E.D. Ky.; 2013 U.S. Dist. LEXIS 146163).
