Daubert Does Not Apply To Methods Underlying Search Warrant, Federal Judge Says

CLEVELAND - The reliability standards in Daubert v. Merrell Dow Pharmaceuticals, Inc. (509 U.S. 579 $(1993$)) do not apply to the probable cause analysis of a search warrant, a federal judge held Oct. 10 in denying a child pornography suspect's motion to exclude computer evidence obtained under a warrant (United States of America v. Joseph Pirosko, No. 5:12CR327, N.D. Ohio; 2013 U.S. Dist. LEXIS 146754).
