Medtronic's Role In Procedure Not Preempted; Duty Assumed, Ind. Appeals Court Says

INDIANAPOLIS - The oral representations by Medtronic representatives to a doctor during heart device surgery are not preempted by federal law, and the company voluntarily assumed a duty to the plaintiff, who later died, an Indiana state appeals court ruled Oct. 11 (Medtronic, Inc. v. Lori A. Malander, et al., No. 49A02-1211-CT-925, Ind. App.; 2013 Ind. App. LEXIS 499).
