Judge: Asbestos Insulation An 'Improvement'; Statute Of Repose Bars Action

CHICAGO - Addressing what he called an unsettled area of Illinois law, a federal judge on Oct. 22 said a power plant's asbestos-containing insulation was meant to be permanent and constitutes an improvement to real property, invoking the state's statute of repose (Christine Stanley, et al. v. Ameren Illinois Co., et al., No. 12-6073, N.D. Ill.; 2013 U.S. Dist. LEXIS 151772).
