Vessel Owner's Failure To Comply With Warranties Voided Coverage, Judge Rules

HONOLULU - A boat owner's violation of an insurance policy's express warranty against misrepresentation and its violation of the maritime doctrine of uberrimae fidei justified the boat's insurer denying coverage for a claim related to the craft's sinking, a Hawaii federal judge ruled Oct. 24, granting the insurer's motion for summary judgment (Port Lynch Inc. v. Samsung Fire & Marine Insurance Co. Ltd., No. 1:11-cv-00398, D. Hawaii; 2013 U.S. Dist. LEXIS 152678).
