Federal Judge Rules That Tobacco Company Conduct Will Not Be Bifurcated

JACKSONVILLE, Fla. - Nothing in Florida tobacco jurisprudence requires trial judges to bifurcate trials to avoid introduction of wrongful company conduct in the phase in which class membership and compensatory damages are established, a judge in Florida federal court said in an Oct. 28 opinion (In re: Engle Cases, No. 3:09-cv-10000-J-32JBT, M.D. Fla., Jacksonville Div.).
