WASHINGTON, D.C. - A vaccine-injured minor must be alive in order for his parents to receive compensation for lost future earnings, a panel of the Federal Circuit U.S. Court of Appeals ruled Oct. 28 in what it said is an issue of first impression (Harry Tembenis, et al. v. Secretary of Health and Human Services, No. 2013-5029, Fed. Cir.; 2013 U.S. App. LEXIS 21954).
