BROOKLYN, N.Y. - A New York appeals court on Nov. 13 reversed a trial court's order granting summary judgment dismissing claims for alleged breaches of the implied warranty of habitability, finding that triable issues of fact exist as to an apartment owner's mold and water damage claims (Yolanda Roman v. Emigrant Savings Bank-Brooklyn/Queens, et al., No. 2012-03686, N.Y. Sup., App. Div., 2nd Dept.).
