West Virginia High Court Finds Passenger Can Pursue First-Party Bad Faith Claims

CHARLESTON, W.Va. - A majority in West Virginia's Supreme Court of Appeals on Nov. 13 held that because a vehicle passenger, as an insured under an auto insurance policy, was pursuing claims directly against the driver's insurer, she was a first-party claimant and, therefore, entitled to pursue bad faith claims against the insurer (Johanna Dorsey v. Progressive Classic Insurance Co., No. 12-1254, W.Va. Sup.; 2013 W. Va. LEXIS 1286).
