MEMPHIS, Tenn. - A commercial general liability insurer breached its policy when it refused to defend its insured against an underlying personal injury lawsuit, a Tennessee federal judge ruled Dec. 31, further finding that the policy's employers liability exclusion is inapplicable (JNJ Logistics L.L.C., et al. v. Scottsdale Insurance Co., No. 2:10-cv-02741-JPM-cgc, W.D. Tenn., Western Div.; 2013 U.S. Dist. LEXIS 181537).
