8th Circuit BAP Reverses, Remands; Bank Has Valid Lien On Debtors' Property

ST. LOUIS - The U.S. Bankruptcy Appellate Panel for the Eighth Circuit (BAP) on Jan. 9 reversed and remanded a bankruptcy case, determining that a bank - against which the debtors had won a judgment pertaining to preferential transfer - in fact had a valid lien based on the language of the deed of trust (Arvest Bank v. Russell Lee Cook, et al.; Russell Lee Cook, et al. v. Empire Bank [In Re: Russell Lee Cook, et al.], No. 13-6014, Chapter 11, 8th Cir.).
