Insured Failed To File Suit Within Limitations Period, 8th Circuit Panel Affirms

ST. LOUIS - An insured cannot maintain a claim for underinsured motorist coverage against an insurer because the insured failed to file the suit within two years of the accident, the Eighth Circuit U.S. Court of Appeals said Jan. 15 (Bradley Larson v. Nationwide Agribusiness Insurance Co., No. 13-1289, 8th Cir.; 2014 U.S. App. LEXIS 764).
