Mealey's Litigation Procedure - 9th Circuit Dismisses Appeal, Finds Case Was Stayed Pending Arbitration

PASADENA, Calif. - The Ninth Circuit U.S. Court of Appeals on Jan. 27 dismissed a California-based biomedical company's appeal of a decision finding that claims asserted against a Japanese corporation were subject to arbitration, finding that certain claims were implicitly stayed in a federal district court pending the outcome of arbitration (Marubeni Corporation v. MediVas LLC, No. 12-55375, 9th Cir.; 2014 U.S. App. LEXIS 1646).
