LAKE CHARLES, La. - The Third Circuit Louisiana Court of Appeal on Jan. 30 upheld summary judgment for the defendant in a personal injury action, concluding that the plaintiff's injury occurred "because of his own action in failing to avoid an obvious danger and taking on a task he was ill-equipped or lacked the skill to perform" (Whitney Gary v. Jefferson Davis Council on the Aging Inc., No. 13-713, La. App., 3rd Cir.; 2014 La. App. Unpub. LEXIS 26).
