HOUSTON - The First District Texas Court of Appeals on Jan. 30 ruled that a trial court correctly denied a motion to compel arbitration filed by a defendant in a construction defects action, pointing out that the construction firm waited for more than a year after filing third-party actions and proceeding with discovery to seek arbitration (Tuscan Builders LP v. SH6 LLC, No. 01-13-00685-CV, Texas App., 1st Dist.; 2014 Tex. App. LEXIS 1048).
