Mealey's Toxic Tort/Environmental - 2nd Circuit Reverses Ruling Requiring Landowner To Pay Subcontractor

NEW YORK - A Second Circuit U.S. Court of Appeals panel on March 18 held that the Comprehensive Environmental Response, Compensation, and Liability Act does not require a landowner to pay a subcontractor for remediation work that it was not paid pursuant to an agreement with a general contractor (Price Trucking Corp. v. Norampac Industries Inc., No. 11-2917-cv, 2nd Cir.; 2014 U.S. App. LEXIS 5093).
