Mealey's Banking & Finance - Judge Dismisses Majority Of Man's Suit Over Denied Loan Modification

CHICAGO - A federal judge in Illinois on March 19 dismissed the majority of a man's lawsuit stemming from a lender's refusal to offer him a permanent loan modification, finding that the Home Affordable Modification Program (HAMP) does not provide a private cause of action for borrowers and that he failed to state claims upon which relief could be granted (David J. Pniewski v. U.S. Bank, N.A., No. 13 C 3638, N.D. Ill.; 2014 U.S. Dist. LEXIS 35586).
