BALTIMORE - A Maryland federal judge on March 21 dismissed a False Claims Act/Anti-Kickback Statute lawsuit against three drug manufacturers after finding that in his second attempt, a whistle-blower failed to specify how the defendants' alleged off-label marketing of a prescription pain patch resulted in false claims being submitted to federal health care programs (United States, et al., ex rel. Jerome Palmieri v. Alpharma, Inc., et al., No. ELH-10-1601, D. Md.; 2014 U.S. Dist. LEXIS 37172).
