Mealey's Insurance - Magistrate Refuses To Declare Insurer Has Right To Control Defense In Defects Lawsuits

DALLAS - A Texas federal magistrate judge on March 25 declined to declare that an insurer has the right to control the defense of an insured in two underlying construction defect cases and that the insured is not entitled to the appointment of independent counsel (Centex Homes v. Lexington Insurance Co., No. 13-719, N.D. Texas; 2014 U.S. Dist. LEXIS 38710).
