Mealey's Insurance - Insured Did Not Allege Separate Acts By Adjustor, Administrator, Judge Finds

PHOENIX - Because a plaintiff alleged only one tortious act in his bad faith lawsuit against his workers' compensation provider, an Arizona federal judge on April 11 found that aiding and abetting claims against a claims administrator and claims adjuster must be dismissed for his failure to allege that these defendants "took separate action in concert with the action giving rise to" the bad faith claim (David Ortiz v. Zurich American Insurance Co., et al., No. 2:13-cv-02097, D. Ariz.; 2014 U.S. Dist. LEXIS 50414).
