Mealey's Insurance - Judge: Insurer Breached Duty To Defend By Refusing To Pay For Insured's Counsel

CHICAGO - Because there is a conflict between a pipe manufacturer insured and its commercial general liability insurer, the insurer breached its duty to defend the insured by refusing to pay for counsel of the insured's choosing, an Illinois federal judge ruled April 21(Perma Pipe Inc. v. Liberty Surplus Insurance Corp., No. 13 C 2898, N.D. Ill., Eastern Div.; 2014 U.S. Dist. LEXIS 54867).
