Mealey's Insurance - Panel Vacates Judgment On Insurer's Liability To Defects Claims Against Insured

ATLANTA - A trial court erred in not setting off a greater amount when calculating an insurer's liability toward an underlying construction defects judgment against an insured, a Georgia appeals panel ruled April 18, vacating in part the judgment against the insurer and remanding for a correction of the judgment (Builders Insurance, a mutual captive company v. Sheldon Tenenbaum, No. A14A0515, Ga. App., 1st Div.; 2014 Ga. App. LEXIS 294).
