Mealey's Insurance - Judge: Professional Liability Insurer Has Duty To Defend Tainted-Drug Lawsuits

ROANOKE, Va. - A professional liability insurer has a duty to defend a professional corporation and its two diagnostic radiologists against underlying lawsuits arising from the purchase and administration of an allegedly tainted drug, a Virginia federal judge ruled April 18, dismissing the insurer's declaratory judgment action seeking to dispute coverage (Medical Mutual Insurance Company of North Carolina v. Image Guided Pain Management, et al., No. 7:13-cv-00499, W.D. Va.; 2014 U.S. Dist. LEXIS 54733).
