Mealey's Bankruptcy - 4th Circuit Reverses, Remands Case For Calculation Of Award For Chapter 7 Trustee

RICHMOND, Va. - A panel of the Fourth Circuit U.S. Court of Appeals on April 28 reversed and remanded a ruling, determining that a bankruptcy court needs to determine the proper commission-based fee to pay a Chapter 7 trustee on grounds that the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA) requires that a Chapter 7 trustee be compensated on a commission basis unless there are "extraordinary circumstances" (In Re: Geoffrey A. Rowe, No. 13-1270, Chapter 7, 4th Cir.; 2014 U.S. App. LEXIS 7900).
