Mealey's Insurance - Judge Refuses To Dismiss Insureds' Bad Faith Claim Against Homeowners Insurer

NEW HAVEN, Conn. - Insureds sufficiently asserted a claim for breach of the implied covenant of good faith against their homeowners insurer regarding denied coverage repairs to cracking in their basement, a Connecticut federal judge held April 29, denying the insurer's motion to dismiss (Danny Panciera and Marcia Panciera v. Kemper Independence Insurance Co., No. 13-1009, D. Conn.; 2014 U.S. Dist. LEXIS 59076).
