ST. LOUIS - A Missouri federal judge on April 28 denied dismissal of a design defect claim in a Wright Medical metal-on-metal hip complaint, saying the plaintiff adequately pleaded facts and that dismissal based on Comment k of the Second Restatement of Torts is premature (Lois Annette Anastasi v. Wright Medical Technology, Inc., et al., No. 4:14-53, E.D. Mo., E. Div.; 2014 U.S. Dist. LEXIS 58467).
