Mealey's Insurance - 3rd Circuit Affirms Judgment That Insurer Handled Fire Damage Claim In Good Faith

PHILADELPHIA - A policyholder failed to show by clear and convincing evidence that his commercial insurer acted in bad faith by relying on its adjuster's damage estimate and in awaiting an appraisal decision before issuing payment related to a building fire, a Third Circuit U.S. Court of Appeals panel ruled April 29, affirming a trial court's judgment (Ercole Mirarchi v. Seneca Specialty Insurance Co., No. 13-2129, 3rd Cir.; 2014 U.S. App. LEXIS 8015).
