ST. LOUIS - A split Eighth Circuit U.S. Court of Appeals panel on May 12 affirmed summary judgment for Stryker Corp., agreeing that under Minnesota law, the defendant could not have foreseen in 2002 that the use of its drug pumps in the shoulder joint could cause permanent cartilage damage (Carol Mack, et al. v. Stryker Corporation, et al., No. 12-3130, 8th Cir.; 2014 U.S. App. LEXIS 8806).
