Mealey's Litigation Procedure - Class Action Over Sinkhole Coverage Denial Remanded To Tennessee Court

NASHVILLE, Tenn. - An insurer failed to demonstrate that it was not the proper defendant and that it was not a resident of the State of Tennessee, a Tennessee federal judge ruled May 14, finding that there was no diversity of defendants and remanding to state court a putative class action over the insurer's purported breach of contract and bad faith in denying coverage for sinkhole-related damages (Jack and Barbara Hollins v. Farmers Insurance Exchange doing business as Mid-Century Insurance Co., No. 3:13-cv-01026, M.D. Tenn.; 2014 U.S. Dist. LEXIS 66165).
