Mealey's Banking & Finance - Debt Collector, Bank Had Authority To Foreclose, 6th Circuit Panel Rules

CINCINNATI - A Sixth Circuit U.S. Court of Appeals panel on June 2 upheld a federal judge in Michigan's ruling dismissing a woman's lawsuit against a bank that was assigned her loan and the law firm hired to handle foreclosure proceedings, finding that the defendants had authority to foreclose on her home despite not being the holder of the promissory note (Nancy Gardner v. Quicken Loans Inc., et al., No. 13-2257, 6th Cir.; 2014 U.S. App. LEXIS 10342).
