Mealey's Insurance - N.Y. Federal Magistrate Denies Motion To Strike Insurer's Complaint

ALBANY, N.Y. - A New York federal magistrate judge on June 10 denied an insurer's motion to dismiss a complaint filed by another insurer and seeking a coverage declaration for an underlying lead-based complaint because the insurer was not willful or did not act in bad faith when it did not produce requested discovery documents by the deadline (Hanover Insurance Co. v. Vermont Mutual Insurance Co., 13-860, N.D. N.Y.; 2014 U.S. Dist. LEXIS 78431).
