Mealey's Elder Law - Wife Lacked Authority To Enter Arbitration Agreements, Pennsylvania Panel Affirms

HARRISBURG, Pa. - A Pennsylvania Superior Court panel in two separate Feb. 6 opinions affirmed a lower court's denial of motions to enforce arbitration agreements in a multidefendant nursing home negligence case, finding in both instances that the wife of the resident lacked the legal authority to execute the agreements on his behalf (Irene Traver v. Reliant Senior Care Holdings, Inc., Nos. 432 and 452, 2020 Pa. Super. LEXIS 80; 2020 Pa. Super. Unpub. LEXIS 429).
