Mealey's Insurance - Breach Of Contract Claim Survives Dismissal Bid In Homeowner's Bad Faith Suit

EAST ST. LOUIS, Ill. - An insured is entitled to recover losses from his homeowners insurance provider for losses sustained in a home fire, and the insurer's denial of coverage based on the insured's purported breach of the insurance policy "lacks support in the policy," but the insurer did not act in bad faith in denying coverage, a federal judge in Illinois ruled Dec. 12 (Artis L. Parker v. Allstate Indemnity Co., No. 19-101, S.D. Ill., 2019 U.S. Dist. LEXIS 215803).
