Mealey's Insurance - New York Appeals Panel Upholds Denial Of Stay Over Medical Malpractice Cases

BROOKLYN, N.Y. - The principles of due process and the right of plaintiffs to seek redress in New York courts for medical malpractice claims require that a South Carolina court's liquidation order against a risk retention group is not entitled to full faith and credit or comity by New York courts and related actions, the Second Department New York Supreme Court Appellate Division held Oct. 22, affirming denial of a stay of the claims (Veronica Hala, et al. v. Orange Regional Medical Center, et al., No. 2018-05465, N.Y. Sup., App. Div., 2nd Dept., 2019 NYLJ LEXIS 3794).
