Mealey's Litigation Procedure - No Class In Philadelphia Residents' Suit Over Amtrak's Herbicide Treatments

PHILADELPHIA - A federal judge in Pennsylvania on Oct. 18 denied a motion for class certification filed by residents whose yard abuts railroad tracks and who claim that herbicide treatments by National Railroad Passenger Corp., doing business as Amtrak, seeped into their yard and killed their garden, finding that the plaintiffs' experts were unreliable and so they were unable to establish numerosity or commonality (Jenny Chen, et al. v. Amtrak, et al., No. 18-3617, E.D. Pa., 2019 U.S. Dist. LEXIS 180741).
