Ms. Joann M. Lytle, a partner with McCarter & English LLP, represents companies and individuals engaged in business disputes across a range of industries. She has represented insureds in insurance coverage litigation – including cases involving the insurability of punitive damages – provides general insurance coverage advice to insureds on an ongoing basis, and has been involved in a number of class action suits, including consumer class action suits relating to cable television late fees, automobile insurance rates and rifles.Ms. Lytle has represented numerous clients involved in litigation with insurance carriers. Specific experience includes obtaining a summary judgment requiring an insurance carrier to provide coverage for a $4 million punitive damage verdict awarded against the company; negotiating with insurance carriers to obtain defense of the client named as an additional insured on a policy issued by the carrier; obtaining coverage for environmental contamination claims brought against the insured; and obtaining coverage for claims brought against clients stemming from the Piper Alpha oil platform explosion in the North Sea.
Ms. Lytle successfully defended a major cable television advertising insertion company in an action brought by the owner of a cable television cooking show; and a class action challenging the reasonableness of cable late fees. Mr. Nicholas M. Insua, an associate with McCarter & English LLP, concentrates his practice on insurance recovery litigation exclusively on behalf of policyholders. He has handled matters for policyholders under comprehensive general liability insurance policies, umbrella liability policies, and excess liability policies for all manner of underlying claims; claims under first-party property insurance policies involving property damage, business interruption, extra expense, and other time-element coverages; and claims under directors and officers liability policies, investment management and investment adviser liability policies, errors and omissions policies, inland marine insurance policies, and fidelity and crime policies.
Mr. Insua has handled all phases of litigation, up to and including trial. He has appeared before state courts in New Jersey and Pennsylvania, in federal courts in New Jersey and New York, and has been admitted pro hac vice to practice around the country, including California, Connecticut.
