Nevada Judge Lifts Ban on Issuance of Marijuana Distribution Licenses

A Nevada district court judge on August 17 lifted his August 11 temporary restraining order prohibiting the Nevada Department of Taxation from issuing marijuana distribution licenses to anyone other than licensed wholesale alcohol distributors.
 
Nevada District Court Judge James Russell ruled in Independent Alcohol Distributors of Nevada v. Dep’t of Taxation that he did not have the power to overturn the department’s determination that the number of licensed wholesale alcohol distributors was insufficient to exclusively supply the recreational marijuana market in Nevada and denied the motion for injunction.
