LexisNexis Tax Advisor-Federal Code: Stimulus Bill Increases Small Business Stock Sale Exclusion

The American Recovery and Reinvestment Act of 2009 (ARRA), P.L. 111-5, 02/17/2009, signed into law by President Obama on February 17, 2009, has increased the qualified small business stock exclusion to 75 percent from 50 percent (60 percent for stock of certain empowerment zone businesses) for any gain realized when the qualified small business stock is sold by individuals or non-corporate stockholders, if certain statutory requirements are met. The increased exclusion applies to stock acquired after February 17, 2009 and before January 1, 2011.
