Two recent decisions, Gills v. Nebraska Machine Products Inc. and Sommers v. New Castle County, show employers that the burden is on the claimant to show a connection between the workplace and the injury in a workers' compensation case. A pre-existing disease may disqualify a claim where the employment does not aggravate or combine with the disease to produce the death or disability for which compensation is sought, says Thomas Robinson of LexisNexis.
