Life can throw curveballs at us quickly and unexpectedly. A serious illness or injury – to ourselves or an immediate family member – can mean having to suddenly walk away from a law practice, whether long term or even permanently. If that happened to you, do you have a plan in place? Will your client matters be transitioned and handled properly? Will those working for you get paid? Will you (or your family) get your share of any unpaid or residual fees that come due? Lawyers have an ethical obligation to diligently handle client matters, and to assure the efficient transition of those matters should they become disabled or die. Despite this obligation, many attorneys do not have succession plans in place, and many states do not specifically require attorneys to have such a plan or to designate a successor attorney. For solo and small firm practitioners in particular, an unanticipated closing of a practice can result in adverse, unethical, and even dire financial consequences to the attorney, their family, colleagues, and their clients. Don’t let that happen to you!

A successful contract negotiation strategy starts long before the two parties sit across the table from each other. Getting the most favorable terms for your client often hinges on knowing which terms are “must haves” as opposed to “nice to have” when assessing risk and avoiding contention that can hold up a deal. The ability to adroitly address problematic clauses and clarify ambiguous terms will ensure the negotiation process proceeds smoothly to create a contract that clearly delineates each parties’ rights and obligations.

Some attorneys think that when it comes to negotiating on behalf of a client, “anything goes.” While zealous advocacy is encouraged, lines can be crossed. In this webcast, two practitioners with deep experience guiding and representing other attorneys on professional responsibility matters, will discuss six principles every attorney should follow while engaging in negotiations. These principles will help to ensure the attorney is staying within ethical guidelines while trying to get the best – and later enforceable – outcome for their client.

The environmental landscape – and the litigation that comes with potentially increased enforcement – is expected to undergo significant changes under the Biden administration. What agency priorities will be put into action first? What cases will reach the Supreme and appellate courts? How are states and local governments, as well as citizens and advocacy groups, filling in the enforcement gaps? And how will your clients and practice be impacted? If you’re an environmental lawyer looking to win in administrative and judicial forums, this unique course is a must! In just two half days, attendees learn strategies from experienced practitioners and judges, and gain a deeper understanding of the relationship among litigation problems, substantive environmental law, and science.

The purpose of a brief is very simple: convince the court that your client deserves to win. However, many brief writers lose sight of this goal by creating briefs that are badly written, poorly organized, and ineffectively themed. All too often, briefs become overly long documents filled with extraneous information, and the writers seem to forget that the intended audience is time-pressed judges (and their clerks) looking for the clear delivery of a well-reasoned argument.
