Mystery novelist Arthur Somers Roche once explained that “Anxiety is a thin stream of fear trickling through the mind. If encouraged, it cuts a channel into which all other thoughts are drained.” Roche selectively used anxiety to create fear in the minds of both his characters and readers. By viewing action through that narrow channel, Roche was able to control the anxiety and pace of the reader. It is that same type of control that Larry Pozner and Roger Dodd advocate for inside a court room. Just as Roche hoped to control the reader’s interpretation of events within a novel, so too do our speakers hope to maintain control of an opposing witness through the selective introduction of anxiety. But there is not just the witness whose anxiety can impact your case; there’s also the fact finder, whether that be a jury, a judge or even a panel of judges.
