We can all agree that the role of the litigator is to persuade the jury or judges to agree with our own vision of the case. But the Masters of Cross Examination Roger Dodd and Larry Pozner would describe it somewhat differently: they have touted the role of the litigator as a teacher –in-residence to the fact finder—whether that be a jury, a judge or panel of judges. Their revolutionary stance: that you can do more than simply minimize the damage inflicted by cross examination, that you can, in fact, win your case on cross examination, is centered around the idea of the litigator as a teacher. That philosophy is further supported by American poet, writer, and critic, Mark Van Doren’s definition of teaching: “The art of teaching is the art of assisting discovery.”
Over the next hour, our presenters, Larry Pozner and Roger Dodd, will discuss the movement toward constructive cross examination while reviewing its benefits and delving into two examples.
As coauthors of Cross Examination: Science and Techniques, the pair are widely regarded as the nation’s foremost experts on cross examination. Both have lectured across the world and frequently appeared as legal experts on local and national television.
