PORTLAND, Maine - The Maine Supreme Court on April 3 upheld a ruling that affirmed a board of the Maine Department of Environmental Protection's (DEP) decision to modify an order requiring Mallinckrodt U.S. LLC to excavate and transport the contents of two on-site landfills, rather than five, after finding that the board did not violate the Administrative Procedure Act (APA) (Mallinckrodt U.S. LLC v. Department of Environmental Protection, No. BCD-13-121, Maine Sup.; 2014 Me. LEXIS 57, 2014 ME 52).
