Mealey's Toxic Tort/Environmental - 1st Circuit: Plantiffs Fail To Show Beryllium Injury; Medical Monitoring Denied

BOSTON - A panel of the First Circuit U.S. Court of Appeals on June 10 affirmed dismissal of a consolidated class action lawsuit in which the plaintiffs sought medical monitoring for alleged take-home exposure to beryllium on grounds no plaintiffs had adequately shown that they had developed beryllium sensitization (BeS) (Barry Genereux v. Raytheon Company, No. 13-1921, 1st Cir.; 2014 U.S. App. LEXIS 10718).
