Florida State Jury Awards Motorist $206,308.65 For SLAP Tear After Motor Vehicle Collision With Miami Police Car
Plaintiff Carline Deravil filed a complaint against defendant City of Miami on April 13, 2015, claiming that she sustained serious injuries when the vehicle in which she was riding was struck by a City of Miami police car on June 14, 2014. Specifically, plaintiff claimed that she sustained a tear of the labrum of her shoulder (Type 1 SLAP tear) requiring arthroscopic shaving. Plaintiff received Personal Injury Protection benefits of $9,185. The action was tried to a jury from May 8, 2017 to May 10, 2017. At trial, the City admitted negligence but disputed the extent and permanency of damages suffered by plaintiff.
On May 10, 2017, the jury awarded plaintiff 206,308.65, including $66,308.65 in past medical expenses; $0 for future medical expenses; $20,000 in past pain and suffering; and $120,000 for future pain and suffering. On May 24, 2017, the court entered judgment for plaintiff in the amount of $189,000. According to information provided by plaintiff’s counsel, defendant offered $25,000. Plaintiff demanded $125,000.
