Nurse Bullied By Doctor At Workplace Settles Harassment/Retaliation Claims For $440,000 In Texas State Court
Plaintiff Patricia Hahn was a licensed vocational nurse working for defendants Scott Davidson, M.D.; Scott Davidson, M.D., P.A.; and North DFW Urology Associates. Plaintiff claimed that she was repeatedly bullied by Dr. Davidson during incidents involving screaming, clenched fists, and throwing punches in the air. She claimed that when she complained to human resources, Dr. Davidson called her into an office after business hours and gave her what he described in his trial testimony as a "demonstration" of what screaming was to prove that he had not screamed at her. Plaintiff was eventually fired.
Plaintiff filed an action against Dr. Davidson, his practice, and North DFW Urology Associates in County Court at Law No. 5 in Dallas County, TX, asserting claims of sexual harassment, intentional infliction of emotional distress, assault, and retaliation. On Aug. 8, 2016, while the jury was deliberating, the parties reached a settlement of $440,000. The same day, the jury returned with a verdict awarding plaintiff $1,026,423. The verdict included $348,889 against Dr. Davidson individually and $677, 534 against NFW.
